Nutri-Score before the CJEU: Key questions on voluntary Front-Of-Pack (FOP) nutrition labelling
On 16 June 2026, the French Conseil d'État referred questions to the Court of Justice of the European Union (CJEU) for a preliminary ruling on the interpretation of Article 35(2) of Regulation (EU) No 1169/2011 on the provision of food information to consumers (FIC Regulation). The case raises doubts on the compatibility of the Nutri-Score front-of-pack nutrition labelling scheme with food information rules and may have significant implications for voluntary front-of-pack nutrition labelling across the EU.
