EU introduces maximum delta-9-THC limits for hemp leaf infusions as well as mandatory labelling requirements

Commission Regulation (EU) 2026/1828 amends Regulation (EU) 2023/915 by setting maximum levels of delta-9-tetrahydrocannabinol (Δ9-THC) in hemp leaves for water infusion and hemp leaves infusions.

The maximum Δ9-THC thresholds are

  • Hemp leaves for water infusion: 40 mg/kg
  • Ready to drink hemp leaves infusions: 0.02 mg/kg

Regarding mandatory labelling requirements:

The labelling of the hemp leaves shall bear the following statements in the principal field of vision of the label:

  • Only to be used for water infusion (preparation of a herbal infusion)
  • Shall not be consumed by infants and young children.
  • No fatty ingredients, such as cream or milk, shall be added during steeping
